Examination rules for special equipment operators
Chapter 1 General
Article 1 In order to regulate the examination of special equipment operators,
these rules are formulated, in accordance with the "Special Equipment Safety
Law of the People's Republic of China", "Provisions on the Supervision of
Special Equipment Safety", "Methods for Supervision and Management of
Special Equipment Operators".
Article 2 These rules are applicable to the qualification examination of special
equipment operators (including safety management personnel), within the
scope of the "Classification and Projects for Qualification Recognition of Special
Equipment Operators", which was formulated AND issued by the State
Administration for Market Regulation.
For the welding operators of special equipment, the qualification examination
shall also meet the requirements of relevant safety technical specifications.
Article 3 Special equipment operators shall, in accordance with the
requirements of these rules, obtain the "Special Equipment Safety
Management and Operator Certificate" (see Appendix A for the format), before
engaging in corresponding operations.
Article 4 For the examination and license issuance of special equipment
operators, they shall be handled, in levels, by the local market supervision-
management department at or above the county level. For the specific license-
issuing authority and license-issuing items, they shall be determined and
announced by the provincial market supervision-management department.
Article 5 The license-issuing authority entrusts the examination agency to
organize the examination; OR organizes the examination on its own.
Article 6 The provincial market supervision-management department is
responsible for formulating the specific conditions and entrustment
requirements of examination agency.
The market supervision-management departments at city level, with districts,
OR the license-issuing agencies select and recommend examination agency
across the country, in accordance with the specific conditions of the
examination agency. Provincial market supervision-management departments
coordinate the formation of a examinee library, for examination agency of the
province; AND publish them. Examination agency's examinee library shall
cover all the license-issuing projects in the province.
The license-issuing authority selects the examination agency from the
examinee library of examination agency AND entrusts the examination, through
purchasing services or other methods; announces the name, address, contact
information and examination items of the examination agency entrusted by it,
to the public.
Article 7 For the projects, where there are less operators, such as hyperbaric
chamber, large-scale recreation facility, passenger ropeways, safety valves, the
license shall be issued by the provincial market supervision-management
department. When the provincial market supervision-management department
determines that, the market supervision-management department of city-level,
with districts, OR the county-level market supervision-management department
issue the license, the provincial market supervision-management department
shall uniformly determine the examination agency.
Article 8 The State Administration of Market Supervision is responsible for the
supervision and management of the examination of special equipment
operators nationwide. The local market supervision-management department,
at or above the county level, is responsible for the supervision and management
of the examination of special equipment operators, within its administrative area,
AND the supervision and inspection of examination agency.
Chapter 2 Examination agency
Article 9 Examination agency shall meet the following basic conditions:
(1) Have the qualifications of a legal person;
(2) Have a permanent organization and management department AND a
fixed office, with no less than 3 full-time personnel
(3) Establish an examination management system, including confidentiality,
question assignment, examination paper transportation, on-site
examination, scoring, result reporting, archives, emergency plan, question
bank management and other systems, which can be effectively
implemented;
(4) According to the corresponding examination outline, clarify the
examination scope, examination methods, qualification indicators;
(5) Establish on-site test bases and test centers; have places, equipment,
facilities and capabilities, that meet the requirements of the corresponding
examination outline;
(6) Have test management and examination personnel, who can meet the
needs of the test. Appraisers shall have a college degree or above AND
more than 5 years of work experience in this major; have rich practical
experience; be familiar with examination procedures, examination
management, examination content, scoring requirements; have
corresponding operating personnel qualifications;
(7) The examination site shall be equipped with an informatized person-to-
ID comparison system; retain the examination image data. If necessary, it
shall set up an automatic video capture system on the examination
machine.
Article 10 The main responsibilities of examination agency:
(1) Announce the registration method and test location, test plan, test types,
operation items, registration requirements, test procedures, etc. of the
examination agency;
(2) Announce the scope and items of the theoretical knowledge test and
practical skill test;
(3) Conduct theoretical knowledge examinations and practical skills
examinations, in accordance with the requirements of the examination
outline;
(4) Announce and report the test results;
(5) Establish examination files for special equipment operators;
(6) Submit annual work summary, etc. to the license-issuing authority.
Article 11 Examination agency shall conduct theoretical knowledge
examinations and practical skills examinations, for qualified applicants, at their
examination centers and examination bases. For special reasons, if it is
necessary to use an examination base, other than the institution, to conduct the
examination, it shall report to the license-issuing authority, for written consent,
in advance.
Examination agency shall not engage in the training work of entrusted
examination items.
Article 12 For the examination outline for various types of special equipment
operators, it can be found in the Appendix of this Rule.
Chapter 3 Examination and license issuance
Article 13 The examination procedures for special equipment operators include
application, acceptance, examination, license issuance.
Article 14 Applicants shall meet the following conditions:
(1) The age is over 18 but not more than 60 years old; has full capacity for
civil conduct;
(2) It has no diseases and physical defects that hinder the job; meanwhile
meets the physical requirements of the job application for which it is
applied;
(3) Have a junior high school degree or above; have an education level that
meets the requirements of the corresponding application work items;
(4) Meet the specific requirements of the corresponding examination outline.
Article 15 Applicants shall submit the following application materials to the
license-issuing authority of the place of work or residence (household or
residence permit):
(1) "Application Form for the Qualification of Special Equipment Operator"
(see Appendix B, 1 copy);
(2) Recent 2-inch frontal bareheaded color photos (2 photos), in white
background;
(3) Identity certificate (1 copy);
(4) Certificate of academic qualifications (1 copy);
(5) Physical examination report (1 copy, as required by the corresponding
examination outline).
Applicants may also fill in the application, through the online registration system,
which is designated by the license-issuing authority; attach the scanned
documents (PDF or JPG format) of the materials required to be submitted in
the preceding paragraph.
Article 16 The license-issuing authority shall decide whether to accept the
application, within 5 working days, after receiving the application. Where
supplementary materials are required from the applicant, the applicant shall be
notified, at one time, of the content to be supplemented and corrected.
If the application is accepted, the license-issuing authority shall inform the
applicant of the acceptance result. The applicant shall register with the
examination agency, which is entrusted by the license-issuing authority, with
the acceptance result; take the examination on time.
If the application is not accepted, the license-issuing authority shall inform the
applicant of the result of the rejection AND explain the reasons.
Article 17 The examination agency shall announce the examination time,
location, operation item, and other matters, 2 months before the examination.
If it is necessary to change the examination time, place, operation items, it shall
promptly notify the applicants who have registered.
Article 18 The provincial market supervision-management department is
responsible for establishing an examination question bank; OR adopting a
unified national examination question bank. The test questions in the question
bank shall cover all the knowledge points of the examination outline. The
number of test questions in each test paper shall not exceed 5% of the total
number of test questions in the question bank.
Article 19 Examination agency shall organize examinations, in accordance with
the requirements of the corresponding examination outline; follow the principles
of openness, fairness and impartiality; strictly implement the examination
management system; ensure the quality of examination work.
Article 20 The examinations for special equipment operators include
theoretical knowledge examinations and practical operation skills examinations.
Special equipment safety management personnel is only subject to theoretical
knowledge examinations.
The examination is implemented in a hundred-point system. If a single subject
scores 70 points, it is qualified; if each subject is qualified, the examination is
judged as qualified.
Article 21 The test results are valid for one year. Those who fail a single test
subject can apply for a make-up test, from the original test agency, within one
year. Those who fail in both subjects OR fail the make-up test, shall submit a
new application for the examination to the license-issuing authority.
Article 22 The examination agency shall announce the list of qualified persons,
within 20 working days after the examination; submit the examination results to
the license-issuing authority. If the applicant inquires about the results from the
examination agency, the examination agency shall inform the result to the
applicant.
Article 23 If the license-issuing authority organizes the examination on its own,
it shall meet the above requirements.
Article 24 The license-issuing authority shall complete the examination,
approval, license issuance, within 20 working days after receiving the
examination results.
Chapter 4 Review
Article 25 A license holder shall, one month before the expiration of the validity
period of the certificated item, submit an application for re-examination to the
license-issuing authority, at the place of work or residence (household or
residence permit); submit the following materials:
(1) "Application Form for Qualification Review of Special Equipment
Operators" (see Appendix C, 1 copy)
(2) "Special Equipment Safety Management and Operator License" (original).
Article 26 If the following requirements are met, the re-examination is qualified:
(1) The age is not more than 65 years old;
(2) During the period of holding the license, there are no illegal operations
and no liability accidents;
(3) During the period of holding the license, the operation time of the
certificated item, in the employment record of the "Special Equipment
Safety Management and Operator License", has not been continuously
interrupted for more than 1 year.
Article 27 When the license-issuing authority handles the review, it shall log in
to the "National Special Equipment Public Information Query Platform", to verify
the authenticity and validity of the "Special Equipment Safety Management and
Operator License". If it cannot be verified, the applicant shall apply for license
again OR return to the original license-issuing authority to submit an application
for review....
